利用規約

この利用規約（以下「本規約」）は、DishSwipe（以下「当サービス」）の利用条件を定めるものです。ユーザーは、本規約に同意のうえ当サービスを利用するものとします。

第1条（適用）

  1. 本規約は、ユーザーと当サービス運営者との間の当サービス利用に関する一切の関係に適用されます。
  2. 当サービス上で掲載するルール、ガイドライン、注意事項等は、本規約の一部を構成します。
  3. 本規約の内容と個別の定めが矛盾する場合、個別の定めが優先されます。

第2条（サービス内容）

  1. 当サービスは、ユーザーの入力情報（気分、場所、条件等）に基づき、飲食店候補の表示・比較・外部地図サービスへの遷移機能等を提供します。
  2. 表示される店舗情報（営業時間、価格帯、評価、写真等）は第三者提供情報を含み、最新性・正確性・完全性を保証するものではありません。
  3. 当サービスは、検索結果の高速化、安定提供、品質改善等のため、外部サービス由来の店舗情報を取得・加工し、一定期間キャッシュまたはデータベースに保存して再利用する場合があります。
  4. 当サービスは、ユーザーへの事前通知なく、機能追加・変更・停止・終了を行う場合があります。

第3条（利用環境）

  1. ユーザーは、自己の責任と費用で、当サービス利用に必要な端末、通信環境、ソフトウェア等を準備するものとします。
  2. 通信料等はユーザーの負担とします。

第4条（位置情報の利用）

  1. 当サービスは、ユーザーが許可した場合に限り位置情報を取得します。
  2. 位置情報は、店舗候補検索等の機能提供のために利用されます。
  3. ユーザーは端末設定により、いつでも位置情報提供を停止できます。

第5条（禁止事項）

ユーザーは、当サービス利用にあたり、以下の行為をしてはなりません。

  1. 法令または公序良俗に反する行為
  2. 犯罪行為に関連する行為
  3. 当サービス、他のユーザー、第三者の権利・利益を侵害する行為
  4. 当サービスの運営を妨害する行為（不正アクセス、過度なリクエスト、スクレイピング等）
  5. 当サービスの不具合や脆弱性を不正に利用する行為
  6. 虚偽情報の入力やなりすまし行為
  7. 反社会的勢力に対する利益供与その他これに準ずる行為
  8. その他、当サービスが不適切と判断する行為

第6条（知的財産権）

  1. 当サービスに関する著作権、商標権その他の知的財産権は、当サービス運営者または正当な権利者に帰属します。
  2. ユーザーは、法令上認められる場合を除き、当サービスのコンテンツを無断で複製、転載、改変、再配布等してはなりません。
  3. 外部サービス由来の情報・画像等の権利は、各権利者に帰属します。

第7条（免責）

  1. 当サービスは、当サービスの内容・提供状態について、明示または黙示を問わず、特定目的適合性、有用性、完全性、継続性、無エラー性等を保証しません。
  2. ユーザーは、表示情報を自己の判断と責任で利用するものとし、当サービスは、当サービス利用により生じた損害について責任を負いません。
  3. 通信障害、システム障害、外部サービス仕様変更、データ遅延・欠落等により生じた不利益について、当サービスは責任を負いません。
  4. 外部サイト（Google Maps等）への遷移後の取引・予約・トラブル等は、ユーザーと当該第三者との間で解決するものとします。
  5. 当サービス運営者が責任を負う場合であっても、故意または重過失を除き、賠償責任はユーザーに現実に生じた通常かつ直接の損害に限られます。

第8条（サービスの停止・中断）

当サービスは、以下の場合、事前通知なくサービスの全部または一部を停止・中断できるものとします。

  1. システム保守点検、更新を行う場合
  2. 火災、停電、天災、事故等の不可抗力により提供困難となった場合
  3. 外部サービスの障害・停止等により提供困難となった場合
  4. その他、当サービスが停止・中断を必要と判断した場合

第9条（広告・提携表示）

  1. 当サービスは、将来的に広告表示、スポンサー枠表示、提携コンテンツ表示等を行う場合があります。
  2. 広告・提携表示が含まれる場合、当サービスは合理的な方法で識別表示に努めます。

第10条（利用規約の変更）

  1. 当サービスは、必要と判断した場合、本規約を変更できるものとします。
  2. 変更後の本規約は、当サービス上に掲示した時点または別途定める発効日から効力を生じます。
  3. ユーザーが変更後も当サービスを利用した場合、変更後規約に同意したものとみなします。

第11条（反社会的勢力の排除）

ユーザーは、自らが反社会的勢力に該当しないこと、かつ将来にわたり該当しないことを表明し保証するものとします。

第12条（準拠法・管轄）

  1. 本規約の準拠法は日本法とします。
  2. 本規約または当サービスに関連して生じた紛争については、当サービス運営者所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

This English text is provided for reference only. The Japanese version above is the official and controlling version. If there is any discrepancy between the Japanese version and this English translation, the Japanese version shall prevail.

These Terms of Use ("Terms") set forth the conditions for use of DishSwipe ("the Service"). Users shall use the Service only after agreeing to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between users and the operator of the Service in connection with use of the Service.
  2. Any rules, guidelines, notices, and similar materials posted within the Service form part of these Terms.
  3. If these Terms conflict with any specific provisions, the specific provisions shall prevail.

Article 2 (Service Description)

  1. The Service provides functions such as displaying and comparing restaurant candidates and linking to external map services based on user input (including mood, location, and filters).
  2. Displayed restaurant information, including business hours, price range, ratings, and photos, may include information provided by third parties, and the Service does not guarantee timeliness, accuracy, or completeness.
  3. To improve speed, stability, and quality, the Service may obtain, process, temporarily cache, and reuse restaurant information originating from external services in cache or databases for a limited period.
  4. The Service may add, change, suspend, or discontinue functions without prior notice to users.

Article 3 (User Environment)

  1. Users shall prepare, at their own responsibility and expense, the devices, communication environment, software, and other equipment necessary to use the Service.
  2. Communication charges and similar costs shall be borne by the user.

Article 4 (Use of Location Information)

  1. The Service acquires location information only when the user has granted permission.
  2. Location information is used to provide features such as searching for restaurant candidates.
  3. Users may stop sharing location information at any time through their device settings.

Article 5 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activity
  3. Acts that infringe the rights or interests of the Service, other users, or third parties
  4. Acts that interfere with operation of the Service, including unauthorized access, excessive requests, or scraping
  5. Acts that improperly exploit bugs or vulnerabilities of the Service
  6. Entering false information or impersonating another person
  7. Providing benefits to antisocial forces or similar acts
  8. Any other act that the Service determines to be inappropriate

Article 6 (Intellectual Property)

  1. Copyrights, trademarks, and other intellectual property rights relating to the Service belong to the operator of the Service or the legitimate rights holders.
  2. Except as permitted by law, users may not reproduce, repost, modify, redistribute, or otherwise use content from the Service without authorization.
  3. Rights to information and images originating from external services belong to their respective rights holders.

Article 7 (Disclaimer)

  1. The Service makes no warranties, express or implied, regarding the content or provision status of the Service, including fitness for a particular purpose, usefulness, completeness, continuity, or absence of errors.
  2. Users shall use displayed information at their own judgment and responsibility, and the Service shall not be liable for damages arising from use of the Service.
  3. The Service shall not be liable for disadvantages arising from communication failures, system failures, specification changes of external services, delayed data, or missing data.
  4. Any transactions, reservations, or disputes arising after the user transitions to an external site such as Google Maps shall be resolved between the user and the relevant third party.
  5. Even where the operator of the Service is liable, except in cases of willful misconduct or gross negligence, liability shall be limited to ordinary and direct damages actually incurred by the user.

Article 8 (Suspension or Interruption of the Service)

The Service may suspend or interrupt all or part of the Service without prior notice in the following cases:

  1. When system maintenance, inspection, or updates are performed
  2. When provision becomes difficult due to force majeure such as fire, power outage, natural disaster, or accident
  3. When provision becomes difficult due to failure or suspension of external services
  4. Any other case where the Service determines suspension or interruption is necessary

Article 9 (Advertising and Partnerships)

  1. The Service may in the future display advertisements, sponsored placements, or partner content.
  2. Where advertising or partner content is included, the Service will endeavor to indicate such content in a reasonable manner.

Article 10 (Changes to the Terms)

  1. The Service may amend these Terms when deemed necessary.
  2. The amended Terms shall become effective when posted within the Service or on any separately specified effective date.
  3. If a user continues to use the Service after such changes, the user shall be deemed to have agreed to the amended Terms.

Article 11 (Exclusion of Antisocial Forces)

Users represent and warrant that they do not currently fall under any category of antisocial forces and will not do so in the future.

Article 12 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.
  2. Any dispute arising in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the operator of the Service as the court of first instance.
